Fun House Waiver
This Fun House Waiver (the “Agreement”) sets forth the terms and conditions agreed upon as consideration for being permitted to occupy and use the services offered by Fun House Management Company LLC (“Fun House”). By signing below, the undersigned customer agrees, on behalf of themselves and any minors who the customer accompanies, to be bound by the terms and conditions detailed herein.
1. Responsibility for Minors
You are solely responsible for any minors you accompany while present in Fun House’s location. You must supervise them at all times. Fun House does not have any responsibility to supervise any behavior of any persons present in Fun House’s location, notwithstanding any actions of an apparent supervisory capacity actually taken.
2. Assumption of Risk
The activities available within Fun House’s location are physical in nature, and thus inherently present risks, including but not limited to damage to personal property, physical injury (up to and including serious bodily injury and death), and other damages. You assume all such risks.
3. Waiver and Release
You waive, release, and disclaim all actions, claims, demands, losses, and damages, whatsoever, in law or equity, against Fun House and all of its owners, agents, and representatives, that are in any way derived from or associated with your presence in Fun House’s location or participation in any activities within Fun House.
4. Photography
You consent to Fun House recording photography and/or videography of you while present in Fun House’s location. You assign to Fun House all right, title, and interest you may have in or to such recording, including all copyright, authorship, or publicity rights. You consent to Fun House using such recordings to promote Fun House on its website, social media platforms, advertisements, and other promotional uses.
5. Rules
Fun House reserves the right to set and enforce rules of conduct for all persons present in Fun House’s location. You agree to abide by all posted rules and any directions provided by any Fun House representatives, at all times. Fun House reserves the right to eject anyone from Fun House’s location for any failure to abide by any such rules or directions. You shall not be entitled to any refund of any payment to Fun House if ejected pursuant to this provision.
